Fundamentals #8
Hopefully, you are still reading these and teaching others about our Constitution. Thank you for all the great responces. Here is the beginning of our document:
United States Constitution:
Section 1. “All legislative powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.”
“legislate
“LEG’ISLATE, v.i. [L. lex, legis, law, and fero, latum, to give, pass or enact.]
{ The definitions used here come from “Webster’s 1828 Dictionary.” It was published in 1828, but was in the works for seventy years before that. These definitions are the ones we use to define the terms in our contract. Legal beagles will tell you that it is a legal document so you have to use the “Blacks Law Dictionary” to define the terms. The first Blacks law Dictionary wasn’t created until 1891, after our Constitution was written. It’s we the people, not we the Lawyers.}
Only Congress has the power to enact laws in the Seat of the Government of the United States, not the President and certainly not Judges (but they are). The Congress cannot just haul off and make any law it wants to either. Its laws are limited to carrying out its duties as stated in Article I section 8. Here it is:
“To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States or in any Department or Officer thereof.”
Really read this. It is the duty of Congress to regulate these departments set up by the executive branch, not the President.
This is the very definition of “limited government.”
Congress has the ability to pass any law it wants to in only one place:
Article I section 8:
“To exercise exclusive Legislation in all Cases whatsoever, over such District (not exceeding ten miles square)…”
Congress has the power to make Marijuana illegal within the ten square miles of the capital, but no where else.
The other powers granted to Congress are all administrative, like the President making a Treaty, but has to have the advice and consent of the Senate. The Senate also approves officers presented to them by the President–or not.
The Congress has the power to provide for the punishment of the following laws in Article I section8–ONLY!
“To provide for the Punishment of counterfeiting the Securities and current Coin of of the United States;”
“To define and punish Piracies and Felonies committed on the high seas, and offenses against the Law of Nations;”
Jack is out of the box, and is using its (illegal) powers of legislation to the detriment of every citizen in our once free country. It’s important to your liberty to know when Jack is out of the box. That’s why I’m doing this.
Congress uses a word called “ACT,” like the “Substance Abuse “Act” when they are making sweeping legislation that Congress doesn’t have the power to enact. Here is the supreme Courts ruling on ACTS.
“An unconstitutional Act is not law; it confers no right’s; it imposes no duties; it affords no protection; it creates no office; it is, in legal contemplation, as inoperative as though it had never been passed.” – U.S. Supreme Court, Norton V. Shelby County 118-LL5, 425,442
Section 2. “The House of Representatives shall be composed of members chosen every second year by the people of the several States, and the electors in each state shall have the qualifications requisite for electors of the most numerous branch of the state legislature.”
That’s right, not every bum off the street is supposed to cast a vote for his/her Congressman or woman. To vote for the State Legislature, you have to be a resident, a property owner, a responsible contributing citizen. Collectivist are very adept at telling you that this is just mean spirited. Their mantra, “everyone deserves the right to vote.”
This one violation has led us down the tubes. Bums that are not contributing have the right to vote for someone that is going to give them some of your money–NUTS! That is a Democracy, mob rule, not a Republic.
This country was to be run by the responsible among us, not the sloth. To even sit on a jury, you have to be a freeholder.
A freeholder is one who owns an estate, a home. Remember the eighty twenty rule? Twenty percent of the people do eighty percent of the work. Like the whale having a throat just two inches in diameter, that’s the way it is and there isn’t a damn thing you can do about it.
Next, more Constitution.
In Liberty,
John Conway
