Every one is clamoring for the Federal Government to do something about this unbridled immigration. Wrong target. Here is what our U.S. Constitution says about immigration.
For some reason people think naturalization is immigration–it is not!
Areticle I section 8 (powers granted to congress)
“To establish an uniform rule of Naturalization…”
Naturalization means Citizenship. Congress determines what hoops an immigrant has to jump through to become a naturalized Citizen. This has nothing to do with a foreign national coming across the border and into a State. Here’s what the U.S. Constitution says about immigration.
Article I Section 9:
“The immigration or Importation of such Persons as any of the States now existing shall think proper to admit, shall not be prohibited by the Congress prior to the Year one thousand eight hundred and eight, but a tax or duty may be imposed on such Importation, not exceeding ten dollars for each person.”
(bold mine) (italics mine)
Importation meant the importing of property, namely slaves and could have a tax put on them. After 1808, no more slaves could be imported into any State.
“as any of the States now existing shall think proper to admit…” It is up to the States to determine who crosses its borders, not the Federal Government. The Federal Government was given the power to prevent the importation of slaves, but nothing more. Nothing here gives it the power to force the States to take in immigrants. It was given no power to make immigration laws whatsoever.
The States used to have vagrancy laws until the Seat of the Government through the serene (that’s a supreme Court W/O a spleen or back bone) Court
stuck them down as unconstitutional? If you had no visible means of support, they escorted you back to their border and told you to take a hike. Think about this one, you can’t create a welfare State unless you have a bunch of bums to feed.
Authorities of the State would meet you at the dock and monitor immigrants. If you were deemed undesirable, they put you back on the vessel that transported you here to be returned at the owner of the vessel’s expense.
You need to remind your State Legislatures of this clause and jump in their s–t about selling us down the river–Rio Grand river that is.
The Federal Government you are clamoring to stop this doesn’t have the power to do anything about it, but isn’t telling you this. You’re supposed to know about your Constitution.
Actually,the power to control immigration is not addressed in the Constitution at all. Prior to this convention, the States controlled their own immigration. The tenth Amendment says that if a power is not specifically given to the Federal Government in the Constitution, that power is reserved to the States, or the people. The States still control their own immigration.
Even Caesar Chaves formed his own Miliitia and patrolled the Mexican border to keep cheap labor out of the country When his Militia caught you they beat the snot out of you before they sent you packing to send a message back to your buddies.
Knowledge, that’s what the “N” on the side of the Nebraska football helmets stands for.
Immigration is healthy as long as the numbers can be asssimilated into our culture. Thirty million is more of an invasion. No multi cultured civilization has ever been successful before. Bi lingual –equals Babble.
Here is a tid bit for you. New Mexico is the only State where Spanish and English are both official languages.
